The Will of EDWARD TYNDALL,  1546

In Dei No(mi)ne Amen I Edward Tyndall of the Pull otherwise called the pulle courte in the Countyof Worcest[er] gentilman being sick in body nevertheles being of and in a perfitt mynde and of a good memorie laude and prayse be to almighty god I make this my present testament conteyning herin my last will in maner and forme folowing First I bequeathe my soule to allmighty god my maker and redemer and my body to be buryed when god will dispose

Item I doo give and bequeathe to Joane my wif the some of xlvj li xiij s iiij d in redy money

Item I will and ordeyne that my executeurs shall permitte and suffer the same Joane to have hold and enyoye the fermes of the Scite of the Manor of the Pull aforesayd Queneham and all my parte and porcion of and inBradley shiphouse in the Muyth and all my parte and porcion of and in all the landes medowes lesues and pastures and comons of pasture belonging to the same Shiphouse and the ferme of the Oxhey and froggins with all and singler their appurtenances fro[m] the day of my dethe unto the end of terme and for the hole terme of twelve years then next folowing toward the bringing up of my childern and hirs paing all the rentes yerely and other charges due furth of the sayd fermes and every one of them during the hole sayd termes of xij yeres my will is that the same Joane shall have the profitt of the premisses for the consideracion abovesayd during the sayd termes if she so long lyve and kepe herselff sole and unmaryed and not otherwise For be yt proved that if she dye or els be maryed within the sayd terme of xij yeres That then myn executeurs shall receave levy and take the profitts of the sayd fermes and other the premisses to thuse mayntenance and educacion of the sayd childern during the residue of the sayd termes of xij yeres

Item I do give and bequeathe to the same Joane my wif all suche stuff of houshold as were her owne before the tyme I maryed her And the thirde part of all suche other stuff and implements of houshold as I have except my plate of the Whiche plate I do give and bequeathe to the same Joane six silver spones of the best And to Margaret my daughter two spones And to Lucy my daughter two spones And to Eleanor my daughter two spones And to Elizabeth my daughter the other thre spones

Item I do give & bequeathe to the same Joane all the carrcase of all maner of my cattell during the sayd xij yeres towardes the maynteyning and breding upp of my sayd children and hers if she so long lyve and kepe herself sole and unmaryed And if she happen to dye within the same terms or els happen to be maryed That then I will that my said executeurs shall have and take all the sayd bread of cattell to the profitt and maynteyning of my sayd children and hers during the hole residue of the sayd termes xij yeres Provided alwey that I meane and will and do ordeyne by this my present testement that the stock and store of all money my cattell shallbe had maynteyned and kept as vayleable in number and quantity of ages of yeres as they nowe be of and furth(er) of the said bread during the hole sayd termes of xij yeres

Item I will and ordeyne that after the sayd xij yeres shall happen to be expyred that all my terms of and in all the above sayd fermes wyth their appurtenances shall com and remayne to Thomas Tyndall my sonne And if it happen the same ThomasTyndall to dye before the said xij yeres shall happen to be expyred  Or els if it happen the same Thomas Tyndall to dye before he be maryed That then I will and ordeyne that all the termes of yeres that then shall happen to be remaynyng shalbe distributed amonge my six children that is to say Margaret Tyndall John Tyndall Elenor Tyndall Lucy Tyndall Edward Tyndall and henry Tyndall according to thorder and discrecion of my executeurs

Item I will and ordeyne that after the sayd xij yeres shall happen to be expired and the sayd Thomas Tyndall then being in playne lif and maryd That then the same Thomas Tyndall shall have six of my oxen six kine xx ewes foure bullocks of thre yeres of age and one mare for his husbandry the second best corne wayne the second best dung wayne a fetherbedde that my children doth lye upon and a flock bedd for his serv(a)nts two bedd coverings whereof thone to be that that was his mothers lyend wyth soultwych and thother a whit one and two payer of canvsse shetes Provided alwey and that I will and ordeyne that if it happen not the sayd Johan my wif to be maryed That then she shall have suche a porcion of and in my house of the pull aforesayd of the land belonging to the same and of my sayd cattell towardes her maynteyning and fynding as shalbe thought rite and necessary for her by the discrecon of my sayd executeurs during her lif if she so long happ(en) to be unmaryed notwithstanding the legacy that I have before made therof to the sayd Thomas Tyndall my sonne

Item I will and ordeyne that all the residue of my cattill and the residue of my houshold Except that porceon as I have before bequeathed to my wif shalbe distributed among my sayd six children by the discrecion and appoyntment of my sayd executeurs

Item I do give and bequethe to the sayd Thomas Tyndall my sonne towards his funding for the tyme he shalbe in service wyth Anthony Bocher gentilman or with any such other master the some of vj li  xiij s  iiij d to be delivered to him by the discrecon of my executeurs

Item I doo give and bequeth to Wyllyam  Tyndall my sonne the some of other vj li xiij s iiij d to be delivered unto him by the discrecon of my sayd executeurs.

  Item I do bequeathe to the sayd Willyam Tyndall all my right tytle and interest that I have of and in one Mesuage wyth his appurtenance called wold lands lyeng wythin Wanneswell wythin the parish of barkeley in the County of Gloucester yelding and paying yerely  for the same the rent reserved and the some of vj s viiij d by yere to theyers of the wood lands

Item I do give and bequeathe to the said Joane my wif all the corne and grayne that I do hold by leace of owr soveraigne lorde the king in Oxendan pannyngton and Natton towards her fynding and my sayd childern and hers during the sayd xij yeres she paing yerely the rent reseved for the same yf she so long lyve and kepe her self unmaryed

Item I do give and bequethe to Willyam Higgins and Joane his wif all the corne and grayne that I ought to have furth of Carpenters myll otherwise called Carpenters place And further I do release and quyt clayme to the same Willyam and Joane his wif of all my right possession and termes that I have in the same corne and grayne

Item I will and ordeyne that after the sayd xij yeres be expired or after the decease of the sayd Joane my wif or after the tyme that the same Joane shall happ(en) to be maryd That then all the profitts of the sayd corne and grayne conteyned in the sayd lease of the corne and grayne in Oxendon pannyngton and Natton shalbe devided amonge my sayd six childern by the discrecons and apoyntment of my sayd executeurs

Item I do give and bequeth to Richard Trotman my sonne in lawe and to Katheryn his wif all my right tytle interest and termes of yeres that I have to come and the lease wherein the same termes be conteyned of and in the Scite of the manor of the hurst and the rents of lyverson of the tenannts there and all the landes medowes lesues and pastures belonging to the sayd scite wyth all and singular their appurtences paing yerely to the king H viii the rents and other charges due for the farme And further yeldyng and paing for the same to thands of myn executeurs yereley to thuse of Elizabeth Tyndall my daughter foure pounds of good and lawfull money of England the first payment therof to begynne at the feast of Thanunciacon of owr blessed lady Sainct Mary the virgyn next comyng after the date hereof that is to say xl s And at the feast of Sainct Mycil Tharchanngell then next after that other xl s and so at every feast of Thannunciacon of owr blessed lady         Sainct Mary the virgyn and  saynt Mighell tharchangell xl s during all the sayd termes yet to come in the sayd lease of the sayd ferme of the hurst aforesaid

Item I do give and bequethe to the sayd Thomas Tyndall my sonne my great lute  and all my bokes in my study Except Pellican upon thold testament and Calopyn and all the boks in my cofer in my chamber Whyche books of pellican Calopyn and remaynyng in my cofer and my best shoting bowe and the bowe case I do give and bequeathe to Sir Robert grene paryshe prest of Tewkysbery to be delivered unto him by my sayd executeurs.

Item I do give and bequeath to my sayd executeurs and to every one of them and to their assignes all my right tytle interest and termes of yeres that I have yet to come of and in the lordshipps of the Pull and Burnett for the termes of twelfe yeres next after the date hereof Provided alweys that if the sayd Thomas Tyndall my sonne at the ende of the same xij yeres be thought and founde by the discrecons of my sayd  executeurs to be of suche disposicion discrecon and order as they shall approve and perceave to be honest that then the hole residue of the sayd termes of & in the sayd lordshippe of the Pull aforesayd shall com and remayne to the same Thomas Tyndall my sonne And that the proffit that shall happ(en) to com growe and rise in the sayd lordshipp of Burnet the charge of myn executeurs honestly borne shalbe distributed amonge my sayd six childern at the discrecon of my sayd executeurs

Item I do gyve and bequeathe to Margaret my daughter my bedd  covering that remayneth wyth my frende John Rastell

Item I do give and bequeathe  to John Tyndall my sonne all my holdinge that I have in the ligh nigh Arshton laynes in the County of Wiltesh(ire)and all my Ryght and lease that I have of and in the tyth laies in Ashton and ligh aforesayd payng the yerely rents for the same 

Item I do give and bequeathe to Edward Tyndall and to Henry Tyndall my sonnes all my  termes and lease that I have of and in thre hundreth shepes pasture in Aylworth in the County of  glou(cester)        payng the yerely rent due for the same

Item I will that after the aforesayd xij yeres shalbe expyred That then all my termes and lease that I have of and in the lordshipp of Burnet aforesayd shall come and remayne to Wyllyam higgins my sonne in lawe and to Johane his wif during the hole residue of the termes that then shall happ(en) to be to com in the same

Item I do give  and bequeathe to Thomas Tyndall my sonne my best gowne lyned wyth chamlet

  Item I do give and bequeathe to Wyllyam Tyndall my sonne my ijnd best gowne 

Item I do give and bequeathe to Joane higgins my gowne cloth that remayneth with will(ia)m Allen she paing  for the dressing therof 

Item I do give and bequeth to Thomas Wetherston my whit ambling gelding that is in Tewkesbury park

Item I do give and bequeth to John Rastel my grey ambling nage

Item I do give and bequeath to every one of my executeurs towardes their labours  and paynes to be taken in thexecuting  of this my testament and last will forty shillings a pece of good and lawfull money of England

Item I do give and bequethe to Thomas Erys my servant the some of liij s iiij d in redy money

Item I do give and bequeth to John Nicolls my serva(n)t xl s in redy money

Item I do give and bequeth to Margaret Tyndall the daughter of henry Tyndall the some of Cxiij s  iiijd  over and besides the xx s I did deliver to her of late appointed to her by her uncle Griffyth Tyndall

Item I do gyve and bequeathe to Wyllyam Elys my servannt xl s in redy money my doublet and cloke that I have at the Hurst and my geldyng that the same Wylliam rydeth upon

Item I will and ordeyne that my sayd executeurs doo dystribute for me amonges poore people dwelling in the towne of Tewkysbury xl s in redy money and to the poor people dwelling in the pull xx s in redy money

Item I will that by the discrecion of my executeurs Nich(ol)as hyll shall have a grannt of the holding that Agnes Bracy dwelleth in in the pull and of henidys in the pull  So that the same Nich(ol)as hill will surrender up the holding that he dwelleth in to thuse of the same Agnes

Item I wyl that myn executeurs shall take and cary awey all the court rolls and other boks that remayneth in my study except the boks before bequethed and to mak out grannts therby that is to say to Elys and to James sonne of washborn to the poore man of sydington and all the estate that be to be made in Forthampton and Swynley and to Colman my servant the reversion of a tenement in compton to have to hym for terme of his liff payng in honest fyne And to Wyllyam higgins of the pull the rev(er)sion of his tenement in the pull

Item I will that myne executeurs do pay to my shepard all such wages as he hath deserved

Item I will that my sayd executeurs do pay to theires of the woldlands xl s in redy money

Item I will that myne executeurs doo forgyve all poor people suche somes of money as they doe owe unto me

Item I give and bequeathe to Thomas Gilmyn      my dagger and my best hoses

Item I have forgiven all suche debts as be owing to me in Slymbridge Except the price of a cowe that Thomas Taylor oweth me

Item yf I dye here at the hurst that then I do give and bequeath to Rychard Trotman all my apparell that I have here nowe wyth me Except my dublit clok hoses and my dagger that I have before bequethed.

Item I do owe to George huntley gent by byll obligatory x li So that the same George doe not prefere any matter against me concerning the ferme or ten(emen)ts in Elkeston for any penalty I shuld by reason therof forfeyt to the kings use our soveraigne lorde

Item I do owe to John Pert my sonne in lawe the some of xx li so that the same John Pert do cause to be made to his wif my daughter a sufficient joynter of and in lands and tene(emen)ts that he hath the fee symple therof  to the yerely value of vj li xiij s iiij d  

Item Wyllyam lygon gent oweth to me the some of xiiij li xvj s iiij d over and besyde the hey and strawe that he receaved at my hand 

Item Richard Trotman my sonne in lawe oweth to me clerley with oute any deduction or charge the some of  xxxiij li x s

Item John Rychards doth owe to me clerely all deductions abbated and allowed the some of lxxj s  x d

Item John Bocher the sonne of Maurice Bocher doth owe me by his byll payable at Whitsuntide last the some of xx li   I suppose that my malt at wotton u barkley will amount to the some of xx li  or there nere about 

Item henry hoskyns doth owe me the some of  a vj or a viij li and I must pay him agayne for vj  bease pasture

Item I wyll and ordeyne that if myn executeurs      or any of them at any tyme hereafter have any vexacion or trouble concerning any matter or busynes that toucheth or concerneth me by occasion that they be my executeurs that then and thereupon they and every one of them shall defend themself and be saved harmeles wyth suche a quantyty and porcion  of my goods and cattells as shalbe indent for any suche defense  And that yt shalbe lawfull for them and every one of them to make defalcacons and defalcacons of any of my sayd legacies  according to their discrecons and constreins any     legacy heretofore by me made by this my present testament  to the contrary notwithstanding  And  all the residue of my goodes and cattells moveable and unmoveable where and in what place  so ever theybe founde not before bequethed  I doo give bequeathe and assign to wyllyam laurence my father in lawe John Rastell Thomas wetherston and willyam higgyns my sonne in lawe whom I do constitut ordeyne and make my sole and full executeurs that they and either of them with one will and agreament according to the  trust     that I have in them  they wyll dispose and distribute the sayd goodes and cattells by what nature or manner so ever they be called by amongs my sayd chyldern according to their discrecon  And Further I doo ordeyne and make and also desire Thomas Trotman of Cam and my Cosyn Edward Trotman my old loving frends  my overseers of this my present testament and last will to oversee and take som paynes by their honest  discrecons to assist and ayd  myn executeurs  And also to do all  and every thing according to theffect      gyven to oversers  Furthermo(re) my will is that if any of my yong six childern dye before they be maryed or happen to com to thage able to occupy accordingly their legacyes   That then their legacys shall remayn to the surviveurs of my sayd childern  according to the discrecons and appoyntments of my sayd executeurs  and also I will and ordeyne that the clere yerely value of my woll of this last yeres growing my debts payd that I do owe to Thomas Cooke shall com growe and remayne to thuse profitt and behove of the said Margaret Tyndall my daughter any legacy therof  amonge other heretofore made to the contrary hereof notwithstanding In witnes whereof to this my present testament and last will  made and conveyd in sundry papers I have subscribed my nane  herein the xvij day of August in the yere of o(ur) lord god a thousand fyve hundreth forty and six thos being witnes hugh Elys thomas Gylman and Thomas Frape wyth other mo
